 Abstract 

The article examines the gaps in the legal provision of human rights in the context of the development of non-international armed conflicts. Attention is drawn to various political assessments that can be voiced when interpreting conflicts within a country, when various states are interested parties. It was determined that the regime of an armed conflict of a non-international character is provided for by the Second Additional Protocol to the Geneva Conventions of August 12, 1949, concerning the protection of victims of armed conflicts of a non-international character - Protocol II of June 8, 1977. It is pointed out that there is no single concept of "war" that influences the ambiguity of the interpretation of a non-international armed conflict. The main guarantees of observance of human rights in conditions of such a conflict are highlighted. Attention is drawn to the status of private military companies.
